1 Taraflar ve KapsamParties and Scope

Bu Kullanım Koşulları, CeeOTech Yazılım ve Danışmanlık ("Şirket") ile CeeOGreen platformuna kayıt olan veya platformu kullanan gerçek ya da tüzel kişi ("Kullanıcı") arasındaki sözleşmeyi oluşturur.

These Terms of Use constitute the agreement between CeeOTech Software & Consulting ("Company") and the individual or legal entity ("User") who registers or uses the CeeOGreen platform.

Platform; karbon ayak izi hesaplama, emisyon yönetimi, raporlama ve danışmanlık altyapısı hizmetlerini kapsar.

The platform covers carbon footprint calculation, emission management, reporting, and consulting infrastructure services.

2 Hesap Oluşturma ve GüvenlikAccount Creation and Security

Platforma kayıt olabilmek için:

To register on the platform:

• 18 yaşından büyük olmanız veya kurumunuzu temsil yetkisine sahip olmanız gerekmektedir
• You must be over 18 years of age or have authority to represent your organization
• Doğru ve güncel bilgiler sağlamanız zorunludur
• You are required to provide accurate and up-to-date information
• Her kurum için tek bir hesap oluşturulabilir (danışman hesapları hariç)
• Only one account can be created per organization (excluding consultant accounts)

Hesap güvenliğinizden siz sorumlusunuz. Yetkisiz erişim tespit ettiğinizde derhal [email protected] adresine bildirin.

You are responsible for the security of your account. If you detect unauthorized access, immediately notify [email protected].

3 Abonelik ve Ödeme KoşullarıSubscription and Payment Terms

CeeOGreen'de farklı abonelik planları mevcuttur. Abonelik koşulları:

CeeOGreen offers different subscription plans. Subscription terms:

• Abonelik ücretleri peşin tahsil edilir; seçilen plana göre aylık veya yıllık faturalanır
• Subscription fees are collected in advance; billed monthly or annually depending on the selected plan
• Yıllık planlarda iptal durumunda kullanılmamış süreye ait kısmi iade yapılabilir
• For annual plans, a partial refund for unused period may be made upon cancellation
• Fiyat değişiklikleri en az 30 gün öncesinden bildirilir
• Price changes are notified at least 30 days in advance
• Ödeme gecikmeleri 14 gün içinde giderilmezse hesap askıya alınabilir
• If payment delays are not resolved within 14 days, the account may be suspended

4 Kullanım Hakları ve LisansUsage Rights and License

Şirket, geçerli bir abonelik süresince Kullanıcı'ya aşağıdaki hakları tanır:

The Company grants the User the following rights during a valid subscription:

• Platforma yetkili kullanıcılar aracılığıyla erişim hakkı
• Right to access the platform through authorized users
• Emisyon verilerini girme, hesaplama ve raporlama hakkı
• Right to enter, calculate, and report emission data
• Oluşturulan raporları PDF/Excel formatında indirme ve paylaşma hakkı
• Right to download and share generated reports in PDF/Excel format
• API entegrasyonu (ilgili plan kapsamında)
• API integration (within the relevant plan scope)

Bu lisans devredilemez, alt lisans verilemez ve yalnızca abonelik kapsamındaki kurumun kullanımına aittir.

This license is non-transferable, non-sublicensable, and belongs solely to the organization within the subscription scope.

5 Yasaklı KullanımlarProhibited Uses

• Platforma yetkisiz erişim sağlamak veya güvenlik sistemlerini aşmaya çalışmak
• Gaining unauthorized access to the platform or attempting to bypass security systems
• Yanıltıcı veya sahte emisyon verileri girmek
• Entering misleading or fraudulent emission data
• Platformun kaynak kodunu kopyalamak, tersine mühendislik yapmak veya türev ürün geliştirmek
• Copying the platform source code, reverse engineering, or developing derivative products
• Üçüncü taraflara yetkisiz erişim sağlamak veya hesap bilgilerini paylaşmak
• Providing unauthorized access to third parties or sharing account credentials
• Platformu otomasyon araçlarıyla aşırı yüklemek veya servis dışı bırakmaya çalışmak
• Overloading the platform with automation tools or attempting to take it out of service
• Mevzuata aykırı amaçlarla kullanmak
• Using for purposes contrary to applicable law

6 Veri SorumluluğuData Responsibility

Kullanıcı, platforma girdiği tüm verilerin doğruluğundan ve bütünlüğünden sorumludur. Şirket, kullanıcı tarafından girilen verilerin doğruluğunu garanti etmez.

The User is responsible for the accuracy and completeness of all data entered into the platform. The Company does not guarantee the accuracy of data entered by users.

Emisyon hesaplama sonuçları, girilen verilerin kalitesine bağlıdır. Resmi raporlama öncesinde verilerin uzman tarafından doğrulanması tavsiye edilir.

Emission calculation results depend on the quality of data entered. It is recommended to verify data by an expert before official reporting.

7 Fikri MülkiyetIntellectual Property

Platformun tüm bileşenleri — yazılım, tasarım, algoritmalar, emisyon hesaplama metodolojileri ve içerikler — CeeOTech Yazılım ve Danışmanlık'ın mülkiyetindedir ve telif hakkı ile ticari marka mevzuatıyla korunmaktadır.

All components of the platform — software, design, algorithms, emission calculation methodologies, and content — are the property of CeeOTech Software & Consulting and are protected by copyright and trademark legislation.

Kullanıcı tarafından platforma yüklenen veriler Kullanıcı'ya aittir. Şirket bu verileri yalnızca hizmet sunumu amacıyla kullanır.

Data uploaded to the platform by the User belongs to the User. The Company uses this data only for the purpose of providing services.

8 Sorumluluk SınırıLimitation of Liability

Şirket, aşağıdaki durumlardan kaynaklanan zararlardan sorumlu tutulamaz:

The Company shall not be held responsible for damages arising from the following:

• Kullanıcı kaynaklı hatalı veri girişi
• Erroneous data entry by the User
• Üçüncü taraf altyapı kaynaklı kesintiler (force majeure dahil)
• Outages caused by third-party infrastructure (including force majeure)
• Regülasyon değişikliklerinden kaynaklanan uyumsuzluklar
• Non-compliances arising from regulatory changes
• Kullanıcının yetkisiz üçüncü taraflara hesap erişimi vermesi
• User granting account access to unauthorized third parties

Şirketin toplam yükümlülüğü, olayın gerçekleştiği aydaki abonelik ücretiyle sınırlıdır.

The Company's total liability is limited to the subscription fee of the month in which the event occurred.

9 Fesih ve Hesap KapatmaTermination and Account Closure

Kullanıcı tarafından fesih: Abonelik döneminin sonunda iptal talebinde bulunabilirsiniz. Verilerinizi indirmek için 30 gün süreniz olur.

Termination by User: You may request cancellation at the end of the subscription period. You will have 30 days to download your data.

Şirket tarafından fesih: Koşulların ihlali halinde Şirket, hesabı önceden bildirim yapmaksızın askıya alabilir veya sonlandırabilir.

Termination by Company: In case of breach of terms, the Company may suspend or terminate the account without prior notice.

Hesap kapatıldıktan sonra veriler 30 gün içinde sistemden silinir (yasal saklama yükümlülükleri hariç).

After account closure, data is deleted from the system within 30 days (except for legal retention obligations).

10 Uygulanacak Hukuk ve UyuşmazlıkGoverning Law and Disputes

Bu Kullanım Koşulları, Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda İstanbul Mahkemeleri ve İcra Daireleri yetkilidir.

These Terms of Use are governed by the laws of the Republic of Turkey. Istanbul Courts and Enforcement Offices have jurisdiction in disputes.

Şirket, bu koşulları önceden bildirim yaparak değiştirme hakkını saklı tutar. Değişiklikler yayımlandıktan 30 gün sonra yürürlüğe girer.

The Company reserves the right to modify these terms with prior notice. Changes take effect 30 days after publication.
